Dave Ramsey – Credit Card/Debt Collectors are SCUM

My hero, Dave Ramsey, tells of abusive practices and the violation of Federal law incorporated by debt collectors – particularly credit card debt collectors. Most people do not know that they have rights guaranteed to them by the Fair Debt Collection Practices Act (FDCPA) and debt collectors knowingly and habitually break these laws in order to frighten them into paying. IT IS NOT AGAINST THE LAW TO OWE MONEY! Do not allow yourself to be lied to (example: “You’re going to go to jail if you don’t pay this” is one of their favorites!) or treated without the dignity you deserve. KNOW YOUR RIGHTS UNDER THE FDCPA: Collectors can NOT call you before 8 am or after 9 pm Collectors can NOT threaten to have you arrested or charged with a crime if you dont pay Collectors can NOT continue to call after you have indicated you want them to stop (record your conversation with them, tell them you ARE recording it, write the date and time down in a journal, and follow up with a certified letter stating they may no longer call.) Collectors can NOT call friends, family members or colleagues repeatedly in order to get you to pay (they may call your acquaintances ONCE in order to track you down and may NOT mention that you owe money or give ANY information that would lead someone to believe that they are attempting to collect a debt.)     please be aware of the differences between 1st and 3rd party collections as the reguations and governing laws are seperate fdcpa does not apply to 1st party …and 3rd party collectors spend endless hours on meticulously choosing wording and approach towards the debtors. as adebt collector we fear the trapping of the professional debtors.

    I agree that there are a lot of agencies that walk in the grey area of the law. This is not a good way of doing any sort of business. However, I make my living as a debt collector. I treat every person that I talk to with the dignity and respect that they deserve. 90% percent of the time, I’m thanked when the conversation is over. I do not deal with credit cards personally, but larger defaults. In many cases, the banks are willing to work with the customer to resolve for much less. FYI

    I just wanted to add, if you just talk to the collector for a minute, you can get a feel for if something can be worked out. If you feel abused or harassed in any way, that is against the law and should be reported immediately. If the customer is not willing to talk about it, or work anything out then it is the banks right to try to collect, but respect shall be given. Once again, shoot for that lower settlement. They are out there.

    @echancey525 You are a minority in your line of work. There certainly needs to be more people like you in that area. Kudos to you for being a good person, and treating others with respect and dignity. I am sure the people you deal with appreciate the way you treat them.

    @genothetank What insightful advice. “pay your bills” I’m sure if it truly were that easy then there wouldn’t be any issues now would there? After all, people in debt never accumulate that debt because of say, unforeseen medical issues. No one is ever possibly without insurance and thus end up easily having hundreds or even thousands to pay on a single ER visit. No one is ever possibly out of work because they’re physically unable to work, or cannot find work, etc. It’s easy for you to judge.

You do understand that you do not know what situation a person is dealing with, or why/how they got into debt in the first place, right? You do realize that people can rack up medical debts through simply being uninsured and “stupidly” needing to seek medical care when the need arises, right? Ever walk into the ER without insurance? Ever been unable to work because you’re disabled? It’s easy for you to sit there and judge. Sad.

    @Seccsi Someone has poor character because they’re unable to pay a debt in full? if that’s truly what you think then you need to open your eyes. Not everyone that is in debt is in debt because they refused to pay their credit card bill. See how easy it is to get in debt when you’re uninsured and unable to work to pay those medical debts because you’re disabled, or just got laid off because your company needed to do cuts. There’s no poor character in a person that finds themselves in that mess.

    @EppstaProductions You sound pretty ignorant yourself if you truly think that everyone in debt is in debt because they were being irresponsible, or because they took out credit cards they couldn’t afford. Try being uninsured and needing to seek medical treatment. See how large those bills get for even the smallest things. Try paying a $5k ER visit when you can’t work due to disability, or because your company laid you off due to cutbacks. Don’t judge when you don’t know the situation at hand.

    @iamnotanigloo I am fully aware of people are unable to pay their medical bills due to debilitating circumstances, and no, they don’t fall into the same situations as I have described. If you had read my posts in their entirety you would have noticed that I was speaking with another individual about their being proud to claim bankruptcy. Next time you want to try and educate someone you might want to take all their posts on this situation into consideration. But seriously, dont waste my time.

    why would anyone get worked up over a slimy bill collector anyway? Those people are nothing but uneducated buffoons that screwed around in school and are now paying the price with a low rank job like this.Dont believe me? just read lovey10405′s post for proof! 78% of bill collectors cant even qualify for a credit card much less a loan. Just fart into the phone and they will go away!

    when a person has a serious medical condition and waits for ssi to kick in two years and when you can resume payments and they want a judgement whether you pay or not then the creditor being not flexible that is what sucks, especially bankj of america the worse customer service bank in the industry

    There are definitely debt collectors out there that violate the law and that does need to be reported. I haven’t dealt with them personally but have heard a few stories. Beyond that, one thing I do find interesting is that 99 out of 100 comments on vids about debt help don’t seem to be positive, nor provide any help. For every 1 useful post there seems to be 99 providing info on how to not pay your debt, or delay it, but nothing about actual help paying. Just an interesting observation…

    Awesome. Personally, I don’t have any debt other than a mortgage. I learned early that having a credfit card is something that rubes, marks, and suckers do, not intelligent people. A debit card is all one needs, that and a minimal amount of self control. Do I run out of funds every week? Yes, but I plan ahead for that.

    Bill collectors are scum. They’re crooks, absolutely. But people hold some responsibility for getting in to deep waters also.

    My brother had a small fire break out at his house and since I was there the night before his insurance company has sent both myself and brother in law to collection agency to collect $24,000 (24 thousand).

    Never would have thought I’d be agreeing with a guy like Dave Ramsey–let alone admiring him, as I do now… shows how little I actually knew about the guy. This is awesome.

    Above all other things, I cannot stand seeing people harass poor, or momentarily disadvantaged, people: it pisses me off to no end. It’s a way for miserable, pitiful little f—ers to pick on somebody, and feel, for a moment, powerful.

    Debt collectors ARE scum: THEY ARE SOCIAL AND ECONOMIC PARASITES. They could not exist without someone to prey upon. THEY ARE THE ULTIMATE FORM OF TRASH. They’re sad–too sad to even feel sorry for. Let the debt collection industry suck it up, for once, and die. This country’s not going to keep nursing them through life.

    There’s definitely a debtors’ revolution brewing out there. Just got done reading the new e-book, “Stopping the Calls: Guerilla Tactics to Fight Back Bill Collectors.” My phone barely rings anymore!

    Wow, I’m glad you throw us ALL into one large group. I own an small agency in NH and I would never steal from someone’s checking account. Right now, I have on average 3-5 people a week that give me their bank and checking info and have not received one complaint of more being taken out then previously agreed upon. And frankly, if I did take out more than I was allowed to, I could get sued and have the AG looking at me, which is something I don’t need.
